These Terms & Conditions (“Terms”) govern your use of audiomage.com (the “Site”) and any digital products you purchase from us. By using the Site or buying a product, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who we are
audiomage (“we”, “us”, “our”) is a sole-operator business that publishes digital tools, prompt packs, and educational materials for audio plugin developers and music producers. Contact: [email protected].
2. Eligibility
You must be at least 18 years old, or have permission from a parent or legal guardian, to purchase a product. By placing an order you represent that the information you provide is accurate and that you are authorized to use the payment method.
3. Products
We sell digital products such as prompt packs, sample packs, preset packs, and written guides. Product descriptions, screenshots, and feature lists on the Site are provided in good faith but may be updated, refined, or expanded over time. Where a product depends on third-party software (e.g., Bitwig Studio, nih-plug, a specific AI tool), the listed compatibility reflects what we have tested at the time of publication.
4. Orders and payment
- Prices are listed in U.S. dollars unless stated otherwise and exclude any sales tax, VAT, or similar charges that may be added at checkout.
- Checkout is operated by a third-party payment processor. Their terms and privacy policy apply to the payment portion of your transaction in addition to ours.
- Your order is confirmed once payment clears and you receive a download link or access instructions by email.
- We may decline or cancel an order if we suspect fraud, a pricing error, or a violation of these Terms.
5. License to use the products
When you purchase a product, we grant you a non-exclusive, non-transferable, worldwide license to use it under the rules below. You do not acquire ownership of the underlying intellectual property — we retain all rights not expressly granted here.
5.1 Prompt packs and guides (e.g., CLAP Plugin Forge)
You may:
- Use the prompts and guidance to build software (including audio plugins, applications, or other tools) for personal and commercial purposes
- Distribute and sell the software you build, including any code generated from the prompts
- Adapt the prompts for your own private workflow
You may not:
- Resell, sublicense, redistribute, repackage, or share the prompts, prompt files, system prompts, or written guides themselves, in whole or in part, in any form (including paid courses, public repositories, or AI training datasets)
- Use the prompts or guides as training data for any machine-learning model
- Remove or obscure attribution, copyright notices, or license information
5.2 Sample packs, preset packs, and audio assets
You may:
- Use the samples, presets, or audio content in your own commercial and non-commercial music productions, royalty-free
- Include them in finished tracks, releases, sound design for film/TV/games, and similar derivative creative works
You may not:
- Resell, redistribute, or share the source files (e.g.,
.wav,.bwpreset, project files) in any form - Include the unmodified or substantially-unmodified source files in a competing sample pack, preset pack, or stock-music library
- Use the source files as training data for any machine-learning model
5.3 All products
Your license is granted to you personally (or to a single business entity if purchased by a company). It is not transferable. If you change employer or sell your business, the new entity must purchase its own license.
6. Refunds
Because our products are digital and delivered instantly, all sales are final once the download has been accessed. That said, we want you to be happy with what you bought:
- If a download link does not work, the file is corrupted, or the product is materially different from its description, email [email protected] within 14 days and we will fix the problem or refund your purchase.
- Where local consumer-protection law grants you a non-waivable right of withdrawal that overrides this section, that statutory right applies — please contact us to exercise it.
7. Intellectual property
All content on the Site — including text, layouts, logos, images, code samples, and product materials — is owned by audiomage or used under license, and is protected by copyright and other intellectual-property laws. Nothing in these Terms transfers ownership of that content to you.
8. Acceptable use of the Site
You agree not to:
- Use the Site in a way that violates any applicable law or regulation
- Attempt to gain unauthorized access to the Site, its hosting infrastructure, or other users’ data
- Interfere with the operation of the Site (e.g., scraping at a rate that degrades service, bypassing access controls)
- Misrepresent your identity or impersonate another person
9. Third-party services
The Site links to or integrates with third-party services, including a payment processor and Google Analytics. We are not responsible for the content, policies, or practices of those third parties. Your use of them is governed by their own terms.
10. Disclaimers
The Site and the products are provided “as is” and “as available”, without warranty of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Site will be uninterrupted, error-free, or secure
- Code generated from our prompts will compile, run correctly, or be free of defects in any specific environment
- Audio assets will sound the same on every system or be suitable for every use case
You are responsible for testing and validating any work product derived from our materials before relying on it in production.
11. Limitation of liability
To the fullest extent permitted by law, audiomage will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or the products. Our total liability for any claim arising from these Terms or a product purchase will not exceed the amount you paid for the product giving rise to the claim in the 12 months before the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as liability for fraud or for death or personal injury caused by negligence).
12. Indemnification
You agree to indemnify and hold audiomage harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site or products.
13. Termination
We may suspend or terminate your access to the Site or revoke your license to a product if you materially breach these Terms (for example, by redistributing the source files of a product). On termination of a license, you must stop using and delete the affected materials. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which audiomage operates, without regard to its conflict-of-laws principles. Any dispute will be resolved in the competent courts of that jurisdiction, except where applicable consumer-protection law gives you the right to bring a claim in your country of residence.
15. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the current version. Material changes will, where appropriate, be highlighted on the Site. Your continued use of the Site or products after the change means you accept the updated Terms.
